Introduction

ExtraMile Convenience Stores LLC respects your privacy and is committed to protecting it. This privacy policy explains how we protect personal information collected when you visit our websites, use our mobile applications (“apps”), shop at ExtraMile stores, enroll and participate in ExtraMile loyalty programs and otherwise. It describes the categories of personal information we collect, the purposes for which we use that information, your choices about use of your personal information, our security measures, and how you can review and correct information about you. If you are a California resident, please also review the ExtraMile California Supplemental Privacy Policy.

What is Personal Information?

As used in this privacy policy, “personal information” means any information that we directly associate with or use to identify a specific individual, including information like a physical or email address, telephone or fax numbers, usernames, online registration and enrollment information, transaction information and purchasing history, when that information is associated with a person’s name. Personal information does not include information that could not be used to identify a specific person, such as aggregated information collected about a group or category of persons. It also excludes information as to which anything that could have been used to identify a specific person has been removed.

Consent to Privacy Policy

By accessing our websites, using our apps, providing personal information to us online or at any ExtraMile store, enrolling in our customer loyalty programs, or by other means, you are consenting to the collection of this personal information and the use of it as described in this privacy policy, subject to applicable laws.

Information Collection

Information collected directly from visitors and customers. In most instances, you can visit our websites and shop at ExtraMile stores without providing any personal information. However, we may ask you for personal information to provide a service, enroll you in a program or sweepstakes, or carry out a transaction you request. The personal information we collect may include: • contact details, such as your name, title, company/organization name, email address, telephone and fax numbers, and physical address • information about your company and job position • your preferences with respect to email marketing • your inquiries about ExtraMile stores and their products and services • sweepstakes entry and event registration information • feedback from you about products and services offered at ExtraMile stores, our websites and apps, loyalty and other programs • user-preference information for app users • your inquiries about ExtraMile franchise opportunities • in connection with an application for an ExtraMile franchise opportunity, financial information, including bank or customer account information, financial statements, Social Security Number or other national/tax identification number • your inquiries about employment opportunities • in connection with inquiries about employment, Social Security Number, job history, a resume and other information customarily requested with an employment application.

You are not required to provide this information. However, if you choose not to, we may not be able to provide you the requested service or complete your transaction.

Data collected by automated means. We collect certain data about all visitors to our websites, including what pages they view, the number of bytes transferred, the links they click, and other actions taken within our websites and may collect similar data regarding user activity in our apps. When you use or access our apps and websites, we may connect this information with your identity to determine your potential interests in products and services offered at ExtraMile stores or ExtraMile franchise opportunities. We may also use this information to improve our security measures. We also collect certain standard information that your browser sends to every website you visit, such as your Internet Protocol (IP) address, your browser type and capabilities and language, your operating system, the date and time you access the site, and the website from which you linked to our site.

When you shop in ExtraMile stores, transactional and other information, such as the date and description of your purchase, and the dollar amount or value of the transaction may be collected automatically or “passively” by us or by one or more of our third-party service providers. For example, we may use third-party analytics tools that collect information about purchases made at ExtraMile Stores. We treat this information as personal information only if we combine it with or link it to other information that may identify you, such as a loyalty program membership number.

Additionally, where such services are enabled on user devices, our apps may use location services to locate or record your geographic location and exact positioning in real time. You may adjust the settings on your mobile device to allow or prevent the sharing of location information. You should refer to instructions provided by your mobile service provider or the manufacturer of your mobile device to learn how to adjust your mobile device settings. Please note that if you disable the sharing of location information, you may be unable to access some features of our services that are designed for mobile devices.

We may also collect mobile device information using beaconing technology, such as: the device type, model and operating system version, and current IP address. We do not use this technology to collect personal information such as name, mobile telephone number, or email address. To disable our ability to identify your mobile device, you can delete our app, adjust the in-app settings, or turn your Bluetooth to “off” on your device.

Cookies and Web Beacons

Cookies are small files that websites save to your hard disk or to your browser's memory. Our websites may use them to track the number of times you have visited the website, to track the number of visitors to the website, to determine and analyze visitors' use of our websites, to store data that you provide (such as your preferences), and to store technical information related to your interactions with our websites. We may also use session cookies, which are deleted when you close your browser, to store your user ID, to facilitate your movement around our websites (particularly in connection with information searches and order placement) and other information useful in administering the session.

Our sites also may contain electronic images known as Web beacons—sometimes called single-pixel gifs—that allow us to count the number of users who have visited those pages. We may include Web beacons in promotional email messages or newsletters in order to determine whether messages have been opened and acted upon, including whether the recipient clicked on a link in the email or forwarded the email to another person.

Adjusting Browser Settings to Manage Cookies or Send “Do Not Track” Signals: Most Internet browsers automatically accept cookies, but you can usually modify your browser settings to decline cookies or to notify you when a cookie is being placed on your computer. If you choose not to accept cookies, you may not be able to experience all of the features of our websites. Internet browsers also enable you to delete existing cookies, although this means that your existing settings (including stored user IDs and other preferences) will be lost. Some web browsers may also give you the ability to enable a “do not track” setting. This setting sends a signal to the websites you encounter while web browsing. This “do not track” signal is different from disabling certain forms of tracking by declining cookies in your browser settings, as browsers with the “do not track” setting enabled may still accept cookies. Chevron does not respond to web browser “do not track” signals at this time. If we do so in the future, we will describe how we do so in this Privacy Statement.

Our Use of Personal Information

We may use personal information for the purposes set forth below.

We may use your personal information for a variety of purposes, including but not limited to: • Responding to your questions or requests. • Processing and completing your transactions including registration for our loyalty or other programs and tracking your purchases and redemptions in our loyalty programs, and delivering products or services. • Providing you with newsletters, articles, product or service alerts, new product or service announcements, savings awards, event invitations, and other information. • Contacting you about programs, products, or services that we believe may be of interest to you or sharing with you special offers from other companies. • Providing you with personally tailored coupons, programs, promotional information, offers, content, and ads. • Conducting market research, surveys, and similar inquiries to help us understand trends and customer needs. • Analyzing transactions or purchase histories to present customized offers to you or to improve our products, services, programs, and other offerings. • Evaluating your shopping experience or existing products and services, or to create new items. • Improving our websites or apps (including our security measures), or to make our websites and apps easier to use or customizing our websites and apps to your particular preference or interests. • Alerting you about a product safety announcement or recall or correction of an offer, promotion, or advertisement. • Entering you into sweepstakes and promotions or contacting you regarding a contest prize. • Verifying and validating your identity. • Keeping a record of our interactions with you. • Processing and evaluating employment applications and franchise applications.

In order to offer you a more consistent experience in interacting with ExtraMile, information collected by our websites may be combined with information we collect by other means.

Marketing Communications. With your permission, we may use personal data to inform you of products or services, discounts and special offers available at ExtraMile stores. When collecting information that might be used to contact you for marketing purposes, we give you the opportunity to opt-out from receiving such communications. Moreover, each email communication we send includes an unsubscribe link allowing you to stop delivery of that type of communication. If you elect to unsubscribe, we will remove you from the relevant list within 10 business days. You must opt in before we use your mobile phone number to contact you by text message, and you may thereafter choose to opt out of receiving future text messages from us. See below on Text Messaging Services.

Employment Applications. In connection with a job application or inquiry, you may provide us with data about yourself, including your educational background, résumé or curriculum vitae, and other information, including your ethnicity where required or permitted by law. We may use this information throughout ExtraMile, its subsidiaries and affiliates, and its joint ventures for the purpose of employment consideration. We will keep the information for future consideration unless you direct us not to do so.

Franchise Applications. In connection with an application to become an ExtraMile franchisee, you may be required to provide us with a range of personal information, including your educational and employment background, financial information, bank account information, Social Security number, Tax Identification Number, citizenship or residency status, litigation and bankruptcy history, and so forth. We do not keep this information if you do not become an ExtraMile franchisee as a result of making an application.

Disclosure of Personal Information

Except as described below, personal data that you provide to ExtraMile via our websites or apps will not be shared outside of ExtraMile, its subsidiaries and affiliates and its joint ventures without your consent.

Disclosure to service providers. ExtraMile contracts with other companies to provide services on our behalf, such as hosting websites, sending out information, supporting and tracking transactions for loyalty programs, processing transactions, and analyzing our websites. We provide these companies with only those elements of personal information they need to deliver those services. These companies and their employees are prohibited from using that personal information for any other purposes.

Disclosure in connection with transactions. In connection with certain transactions, we may disclose some or all of the personal information you provide to certain financial institutions, government entities, suppliers, distributors, shipping companies or postal services involved in fulfilling the transaction.

Disclosures in connection with acquisitions or divestitures. Circumstances may arise where for strategic or other business reasons ExtraMile decides to sell, buy, merge or otherwise reorganize particular businesses. Such a transaction may involve the disclosure of personal data to prospective or actual purchasers or receiving it from sellers. Although it is our practice to seek protection for information in these types of transactions, we cannot guarantee that any entity receiving such information in connection with one of these transactions will comply with all of the terms of this privacy policy.

Disclosure on collaborative websites. Some of our websites may promote collaboration among registered users with respect to a particular area or topic. On those websites, we may share your username with other participants to label comments or suggestions that you make as yours. We do not, however, share your name, contact details, or other personal data with other users of those collaborative websites.

Disclosure for other reasons. We may disclose personal information if required to do so by law or in the good-faith belief that such action is necessary to comply with legal requirements or with legal process served on us, to protect and defend our rights or property, or in urgent circumstances to protect the personal safety of any individual.

Text Messaging Services

When you agree to receive text messages from us, for example, in connection with enrollment in a loyalty program, you are expressly consenting to receive text messages on your cell phone or other mobile device about our products, services, and/or programs which may be sent by automated means. Text messages will only be sent to the mobile phone number used to opt into the applicable text message program. For information about a text message program you may text HELP to the applicable short code.

Message and data rates may apply. This means that your carrier may charge you for each message we send to you or that you send to us. It is your responsibility to know whether your carrier will charge you a per-message fee. We do not charge a fee for our text message programs and assume no responsibility for charges by your carrier you may incur when you sign up to receive text messages from us.

You may opt out of a text message program at any time by texting the word STOP to the applicable short code from an enrolled device. You will receive a final confirmation message that will confirm that you will no longer receive text messages from the applicable text message program unless you opt back into such program.

International Transfers of Personal Information

We may transfer personal information that we collect through our websites and apps to, and store such information in, countries other than the country from which that information was initially collected or the countries from which individual site visitors may access these sites or use these apps. The countries, including the U.S. (and the other countries around the world where our individual subsidiaries, affiliates, suppliers, or business partners maintain facilities), to which we may transfer such information may have different data protection laws than the countries from which the information was initially collected or from which individual site visitors access our websites or are using an app.

By choosing to use our websites or applications and to submit personal information to us through them, you consent to the transfer of such information outside of your country.

To the extent required by applicable law, when we transfer your personal information to recipients in other countries, we will take measures to protect that information.

Personal Information Retention

To the extent permitted by applicable law, we retain personal information we obtain about you as long as (1) it is needed for the purposes for which we obtained it, in accordance with the provisions of this privacy policy or (2) we have another lawful basis, stated in this privacy policy or at the point of collection, for retaining that information beyond the period for which it is necessary to serve the original purpose for obtaining the personal information.

Security

ExtraMile is committed to protecting the security of personal information. While no security measure can guarantee against compromise, we use a variety of security technologies and procedures to help protect data from unauthorized access, use, or disclosure. For example, we store the personal data you provide on computer systems with limited access that are located in facilities to which access is limited. When you move around a site to which you have logged in, or from one site to another that uses the same login mechanism, we verify your identity by means of an encrypted cookie placed on your machine. When you place an order with us, view account information, or provide financial information, we protect the transmission of such data using Secure Socket Layer (SSL) encryption.

For sites to which you log in, it is your responsibility to ensure the security of your password and to not reveal this information to others. If you are sharing a computer with anyone, you should always log out before leaving a website so that subsequent users will not be able to access your data.

Links to Other Websites

Our websites or apps may contain links to other websites, including those of other companies, professional and government organizations, and publications. These websites operate independently from our sites and apps, and we do not control and are not responsible for the content, security or privacy practices employed by other websites. You should review the privacy statements of those websites to determine how they protect and use personal data.

Children

Our websites and apps are general audience platforms, although they contain information that may be of interest to children. However, ExtraMile does not seek through its websites or apps to gather personal information from or about persons 14 years or younger. If one of our websites is directed at children, we will include an additional privacy statement notice for children.

Reviewing Personal Information

In many cases, you can immediately review and correct personal data provided through our websites by going to the page on which you provided the data.

To the extent provided by the law of your jurisdiction, you may have the right to (1) access certain personal information we maintain about you; (2) request that we update, correct, amend, erase or restrict your personal information; or (3) exercise your right to data portability. Where provided by law, you may withdraw consent you previously provided to us or object at any time to the processing of your personal information on legitimate grounds relating to your particular situation, and we will apply your preferences going forward as appropriate.

This California Supplemental Privacy Statement: • supplements the information provided about our collection, use, and sharing of personal information collected through Chevron websites and apps in the ExtraMile Privacy Policy and in site-specific or app-specific privacy statements for specific ExtraMile websites or apps. • provides information more generally about our collection, use, and sharing of personal data related to California residents whether that data is generated through online channels (for example, through consumer use of ExtraMile websites and apps) or offline channels (for example, consumer transaction data collected during retail purchases at ExtraMile convenience stores); and • provides instructions on how to exercise the rights granted to California residents under the CCPA.

Data Collection and Use

We may collect your personal information as an individual for various purposes, including the purposes described below and as further described (with respect to information collected through ExtraMile websites) in the ExtraMile Privacy Policy.

Responding to your request for information, order, or support: When you contact us (online or offline) we may collect information necessary to fulfill your request, to provide you with support and to enable us to contact you. For instance, we may collect your name and contact information, rewards program account number and/or rewards eligibility information, and we may include client satisfaction survey information. We may retain such information for administrative purposes, to defend our rights, and to manage our relationship with you.

Administering websites or other online service: When entering one of our websites, or using an online service, we will record information necessary to provide you with access, for the operation of the website and for us to comply with security and legal requirements in relation to operating our site, such as passwords, IP address and browser settings. We also collect information about your activities during your visit in order to personalize your website experience, such as recording your preferences and settings, and to collect statistics to help us improve and further develop our websites, products and services. Marketing: When you register for an event, we may collect information (online or offline) in relation to the event organization, and during an event, such as participation in sessions and survey results. We may combine the personal information we collect to develop aggregate analysis and business intelligence for conducting our business and for marketing purposes. When visiting our websites or using our services we may provide you with personalized information. Contacting employees of our clients, prospects, partners and suppliers: In our relationship with customers, franchisees, prospective customers and franchisees, and suppliers, they also provide us with business contact information (such as name, business contact details, position or title of their employees, contractors, advisors and authorized users) for purposes such as contract management, fulfillment, delivery of products and services, provision of support, invoicing and management of the services or the relationship.

Managing site visits and securing persons and property: We may register individuals visiting our offices and locations (name, identification and business contact information) and use camera supervision for reasons of security and safety of persons and belongings, as well as for regulatory purposes.
